Scope of Application
These general terms and conditions (GTC) apply to the purchase and redemption of tickets for escape games via our game platform ExitMania.com & Outdoor-Escape-Games.com
Contracting parties
The contract is concluded between the customer and Team Mania GmbH (hereinafter referred to as the "provider").
Purchasing Tickets and Validity
Once purchased, a ticket is valid for 12 months. Within this time, the buyer can use the ticket for the corresponding game. A return or refund of the ticket after purchase is excluded.
Activation and Expiry of Tickets
As soon as the ticket has been redeemed by the customer and the game has started, its validity expires after the game time has elapsed, or after 48 hours at the latest. After that, it is no longer possible to use the login details.
Redemption of vouchers from third-party providers
Buyers of third-party vouchers that are intended for our games can use them directly via a form provided for this purpose on our website. As long as the voucher has not been used on our website, it is valid as long as it has been communicated on the relevant website of the third-party provider. As soon as the voucher is used for a booking via the appropriate form, the period of 12 months after the voucher code has been validated also applies here.
Payment by invoice
Customers who pay by invoice will receive the game login details by email no later than 48 hours before the booked event. The prerequisite is that payment has been received in full by then or that there is a valid proof of payment. Unredeemed or unused accesses are excluded from the refund.
No right to a refund in case of early game termination
Players who cancel the game prematurely are generally not entitled to a refund of their payment. Exceptions apply to technical errors associated with the Loquiz app. If this happens and is plausibly described by the buyer, the payment will be refunded. If, for reasons other than technical reasons, the game is ended early, the further course of action will be decided on a case-by-case basis.
Exclusion of Liability
The provider is not liable for damages caused by improper use or force majeure.
Changes to the Terms and Conditions
The provider reserves the right to change these terms and conditions at any time in order to adapt them to changed legal situations or changes in the offer and data processing.
Final Provisions
Should individual provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. Instead of the invalid or unenforceable provision, a provision shall apply that comes closest to the economic purpose of the invalid or unenforceable provision.
Applicable Law
These Terms and any disputes arising out of or in connection with these Terms shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction
The competent court for all disputes arising out of or in connection with these Terms and Conditions is the court located at the registered office of the provider, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law.
Cancellation Policy
Since the tickets purchased through our platform are services related to leisure activities, there is no statutory right of withdrawal for consumers in accordance with § 312g (2) No. 9 BGB.
